An NRB divorce lawyer in Chittagong lets probashis end a Chattogram marriage from the Gulf, the UK or Asia without flying home for every step. The Bangladeshi procedure still applies in full: notice to the right office, the ninety-day period, registration with a kazi, and documents that foreign authorities will accept. We explain each route.

Key pointA talaq written in the UK and then notified to a Chairman in Bangladesh has generally been refused recognition in England and Wales as a transnational divorce, so UK residents should decide which country's recognition matters before sending any notice.

At a glance

01

Notice to the right office

Talaq notices go to the Chairman or Mayor where the wife lives; in the city, the Chattogram City Corporation, with a copy to the wife.

02

Ninety days to take effect

Under section 7 of the 1961 Ordinance, talaq takes effect ninety days after the Chairman receives notice, unless revoked, or later if pregnant.

03

Online Family Court available

Chattogram's e-Family Court, live since 30 November 2025, accepts dissolution, dower and maintenance suits online with virtual hearings.

04

Registration closes the record

Divorces are registered by the Nikah Registrar under the 1974 Act; embassies and immigration authorities rely on the registered certificate.

05

Recognition abroad varies

UK, Gulf and Asian authorities apply their own recognition rules; split-country talaqs are particularly risky for UK residents.

What an NRB divorce lawyer in Chittagong does

An NRB divorce lawyer in Chittagong helps Bangladeshis living abroad end a marriage registered in Chattogram, or respond to a divorce started by a spouse at home, without having to fly back for every step. The work covers talaq notices, a wife's delegated divorce, khula, Family Court suits, dower and maintenance claims, custody, and the registration and attestation that make the divorce usable abroad.

Chattogram division has one of the largest probashi communities in Bangladesh, with families spread across Saudi Arabia, the UAE, Oman, Qatar, Malaysia, Singapore, the UK and Italy. Marriages are often arranged across that distance, and when they break down the legal questions follow the same pattern: which law applies, which office receives the notice, how to sign documents from abroad, and whether the divorce will be accepted by a foreign immigration office or court.

What changes when you are abroad is logistics, not law. The Bangladeshi procedure still has to be followed in full. Skipped steps are the main reason probashi divorces are challenged years later, when a spouse remarries, sponsors a new partner or applies for a passport.

Talaq and the Muslim Family Laws Ordinance 1961

Under section 7 of the Muslim Family Laws Ordinance 1961, a husband who pronounces talaq must give written notice to the Chairman and send a copy to his wife. The Chairman constitutes an Arbitration Council to attempt reconciliation. The talaq takes effect ninety days after the Chairman receives the notice, unless revoked, or at the end of a pregnancy if that is later. Failing to give notice is an offence.

Section 8 applies the same procedure where a wife exercises a delegated right of divorce (talaq-e-tafweez) recorded in the kabinnama, or where the marriage is dissolved other than by talaq, such as khula by agreement. A wife abroad with a delegated right can therefore end the marriage by notice in much the same way as a husband.

Divorce through the Family Court

A wife without a delegated right can seek dissolution on the grounds in the Dissolution of Muslim Marriages Act 1939, including failure to maintain her for two years, cruelty and an unauthorised second marriage, or seek judicial khula. Under the Family Courts Act 2023, Family Courts hear dissolution, dower, maintenance, restitution of conjugal rights and custody together.

Registration

The Muslim Marriages and Divorces (Registration) Act 1974 provides for divorces to be registered by the Nikah Registrar (kazi). Registration does not itself create the divorce, but the registered record and certificate are what embassies, immigration authorities and future spouses ask to see.

Hindu personal law in Bangladesh does not provide a general divorce procedure, and Christian divorces go through the courts. An NRB divorce lawyer in Chittagong should review the position before any step is taken in a non-Muslim marriage; our Hindu family law team advises on separation and maintenance.

Where it happens in Chattogram

The "Chairman" in section 7 means the head of the local government body with jurisdiction, generally determined by where the wife lives. Sending the notice to the wrong office is one of the commonest probashi mistakes.

  • Chattogram City Corporation area: the notice goes to the Mayor of the Chattogram City Corporation, whose arbitration process handles reconciliation.
  • Pourashavas in the district: the Mayor of the relevant pourashava.
  • Rural unions: the Chairman of the Union Parishad, for example in Sandwip, Satkania, Raozan, Fatikchhari or Banshkhali.

Contested matters go to the Family Courts in the Chattogram judgeship, at the court complex in the Kotwali area. Since 30 November 2025, Chattogram family suits can also be filed and followed online through the e-Family Court portal, with virtual hearings and SMS notices, which is a significant help for a spouse abroad.

Routes to a divorce compared

The right route depends on who wants the divorce, what the kabinnama says, and whether the other spouse will cooperate.

Being abroad changes how the papers travel, not which papers the law requires.

The process step by step

For a talaq or delegated divorce initiated from abroad, an NRB divorce lawyer in Chittagong will usually work through these steps:

  1. Check the marriage record. Obtain a copy of the registered kabinnama. Confirm the dower, how much is unpaid, and whether the right of divorce was delegated to the wife.
  2. Identify the right office. Establish where the wife lives and therefore whether the notice goes to the City Corporation, a pourashava or a Union Parishad.
  3. Prepare and sign the notice. The notice identifies both spouses and the marriage registration and states that talaq has been pronounced, or that the wife exercises her delegated right. Sign and date it.
  4. Arrange authority at home. Where someone in Chattogram will act, execute a power of attorney at the Bangladesh mission and have it authenticated after it arrives, or give a narrower written authority if the mission will not attest a divorce-related power.
  5. Deliver the notice. Send it by tracked courier or registered post, or have your representative deliver it against a receipt. Serve a copy on the spouse by a method you can prove. The ninety days run from the Chairman's receipt.
  6. Arbitration Council. Attend through your representative or remotely, as the office permits. Reconciliation may be attempted; settlement terms can be recorded.
  7. Register the divorce. Once the period expires without revocation, apply to the Nikah Registrar for registration and obtain certified copies.
  8. Prepare for use abroad. Arrange Ministry of Foreign Affairs attestation and any translation or legalisation the destination country needs.
Practical point

Keep proof of every delivery: the courier tracking record, the receipt stamped by the City Corporation and proof of service on your spouse. When a foreign immigration office or a future spouse's family questions the divorce, these papers answer the question in minutes.

If your spouse starts the divorce

Many probashi clients are on the receiving end: a talaq notice arrives at the family home in Chattogram, a Family Court summons is served on a relative, or a message says a suit has been filed. Do not ignore it. A Family Court can proceed in a party's absence, and a decree for dower or maintenance made without your participation is far harder to undo than to contest at the outset.

The first task for an NRB divorce lawyer in Chittagong is to obtain the papers: the notice and the Chairman's file, or the plaint and the order sheet from the Family Court or e-Family Court record. We then check service, deadlines and the claims made, and file a written statement or appear at the Arbitration Council on your behalf.

Where you want the marriage to continue, the Arbitration Council is the forum for reconciliation, and a talaq can be revoked before the ninety days expire. Where you accept that it is over, the focus shifts to negotiating dower, maintenance and children's arrangements on terms you can meet from abroad, and to recording them so that neither side reopens them later.

Husbands abroad sometimes assume that remaining outside Bangladesh puts them beyond the Family Court. In practice, decrees can be executed against property in Chattogram, and unresolved claims surface when you return, sell family land or renew documents. Wives abroad face the mirror-image problem: an unanswered restitution suit can be used against them in later proceedings. An NRB divorce lawyer in Chittagong who files promptly keeps your options open.

Documents, powers of attorney and attestation

A probashi divorce file typically contains:

  • the registered kabinnama or a certified copy;
  • passports and national ID cards of both spouses;
  • the signed talaq, tafweez or khula notice, with proof of delivery;
  • any written khula or settlement agreement covering dower, maintenance and children;
  • a power of attorney or written authority for the representative in Chattogram;
  • children's birth registration certificates where custody or maintenance is in issue.

Under the Power of Attorney Act 2012, a power signed abroad is executed at a Bangladesh mission and authenticated after it reaches Bangladesh. Missions set their own rules, and some decline to attest powers relating to divorce; the Bangladesh High Commission in London publishes its own requirements. Our power of attorney lawyers draft documents that fit the mission's practice.

Recognition abroad: UK, Gulf and Asia

Recognition runs in two directions, and both matter to any NRB divorce lawyer in Chittagong advising a client overseas.

United Kingdom

The law of England and Wales recognises an overseas divorce only if it meets conditions in the Family Law Act 1986. A talaq pronounced or written in the UK and then notified to a Chairman in Bangladesh has generally been treated as a "transnational" divorce and refused recognition, because the process did not take place in a single country. Where both spouses are UK-based, a divorce in the English courts, or careful structuring of where the talaq is pronounced, may be needed. Take advice from a UK family solicitor as well, and we coordinate with them through our London office.

Gulf states

Workers in Saudi Arabia, the UAE, Oman and Qatar often cannot attend Bangladeshi offices in person, and local courts apply their own personal status rules to expatriates. Where a divorce is obtained in a Gulf court, the record in Bangladesh may still need closing through registration here. Our Dubai office helps coordinate documents and attestations.

Malaysia, Singapore and elsewhere

Requirements vary by country and by the purpose, whether a work permit, a new marriage or a dependant visa. Ask the authority what it will accept before choosing a route.

Foreign divorces used in Bangladesh

Under the Code of Civil Procedure 1908, a foreign judgment can be conclusive between the parties but may be challenged on grounds such as lack of jurisdiction or breach of natural justice. Many Muslim probashis therefore also follow the section 7 procedure so the Bangladeshi record is closed. Our guide on divorce from abroad explains the options in more detail.

Dower, maintenance and children across borders

Divorce triggers financial claims. Unpaid dower, prompt or deferred, becomes due, and maintenance is payable during iddat; children's maintenance continues. A wife in Chattogram can sue a husband abroad in the Family Court, and a husband abroad can defend through a lawyer. Reforms to the Code of Civil Procedure in 2025 allow summons to be served electronically, which helps when a spouse lives overseas.

Custody is decided on the child's welfare, applying the Guardians and Wards Act 1890 and personal law. Bangladesh is not a party to the Hague Child Abduction Convention, so preventing an unagreed removal is far easier than securing a return. See our child custody lawyers and dower lawyers for these claims.

Risks and common mistakes

Sending the notice only to the spouse

Many husbands abroad send a talaq letter or message to the wife and stop there. Without written notice to the Chairman or Mayor with jurisdiction, the statutory procedure is incomplete, the ninety-day period has not started, and the husband has committed an offence. The wife may later argue that the marriage continues, with consequences for any second marriage. Send the notice to the correct office, keep proof of receipt, and serve a copy on the wife. An NRB divorce lawyer in Chittagong can confirm the office before anything is posted.

Using the wrong office

The relevant body is generally determined by where the wife resides, not where the marriage was registered or where the husband's family lives. A notice sent to the husband's Union Parishad when the wife lives in the city may be ignored or rejected. If the wife has moved, establish her current residence first. Where the address is genuinely unknown, take advice on service and record every attempt carefully.

Not registering the divorce

Divorces that are never registered cause problems years later. Without a registered record and certificate, immigration authorities may refuse a spouse visa for a new partner, a kazi may hesitate to register a remarriage, and banks or passport offices may still show the former spouse. Registration is a short step once the period has run, and a representative in Chattogram can usually complete it.

Signing away dower in a hurry

Khula commonly involves the wife releasing some or all of her dower, and families abroad sometimes pressure a wife to sign a release quickly. If the kabinnama gave her a delegated right of divorce, she may be able to end the marriage without giving up dower at all. Read the kabinnama before agreeing to khula, and put any agreed terms in a written settlement that covers maintenance and children too.

Mixing foreign and Bangladeshi steps

Starting a talaq in one country and completing it in another can leave a divorce valid in Bangladesh but unrecognised abroad, or the reverse. This is particularly risky for UK residents. Decide at the outset which country's recognition matters most, then design the process so it satisfies that country's rules. Coordinated advice in both jurisdictions costs less than a remarriage later held invalid.

Frequently asked questions

01Can I divorce my wife in Chattogram while I work in Saudi Arabia or the UAE?

Yes. You can sign a written talaq notice abroad and send it to the Chairman or Mayor with jurisdiction over where your wife lives, with a copy to her. In Chattogram city that is the City Corporation. A lawyer or relative can deliver it and attend the Arbitration Council. After ninety days, if not revoked, the divorce takes effect and can be registered with a kazi. Dower and maintenance during iddat then become payable.

02I live in London. Will a talaq sent to Bangladesh be recognised in the UK?

Often not. Courts in England and Wales have treated a talaq pronounced or written in the UK and then notified in Bangladesh or Pakistan as a transnational divorce that cannot be recognised under the Family Law Act 1986. If both of you live in the UK, a divorce through the English courts may be needed. Take advice in both countries before sending any notice; we coordinate this through our London office.

03Can a wife abroad divorce her husband in Chattogram?

Yes. If her kabinnama delegates the right of divorce to her, she can exercise talaq-e-tafweez through the same notice procedure, keeping her financial rights. If not, she can file a dissolution or judicial khula suit in the Chattogram Family Court, which since November 2025 can be filed and followed online, with a lawyer representing her at hearings.

04Do I need a power of attorney?

Not always. You can sign and send the notice yourself. A power of attorney helps when someone in Chattogram must attend the Arbitration Council, apply for registration or conduct a Family Court case. Under the Power of Attorney Act 2012, it is executed at the Bangladesh mission and authenticated after arriving in Bangladesh. Some missions decline divorce-related powers, so check first; a narrower written authority may work instead.

05How do I get a divorce certificate for use abroad?

Once the divorce is effective, apply to the Nikah Registrar for registration and certified copies. For use abroad, the certificate usually needs Ministry of Foreign Affairs attestation, and the destination authority may also require translation or legalisation. Check the receiving authority's requirements in advance, and keep proof of the notice, its delivery and service on your spouse with the certificate.

06My husband abroad sent talaq by text message. Am I divorced?

Not under the statutory procedure unless written notice also reached the Chairman or Mayor with jurisdiction. The ninety-day period runs only from the Chairman's receipt of notice. Contact the City Corporation, pourashava or Union Parishad to check whether a notice was received, and take advice on your dower and maintenance rights, which a husband abroad remains liable to pay.

07Will a divorce from a foreign court be accepted in Bangladesh?

Not automatically. Under the Code of Civil Procedure 1908, a foreign judgment may be conclusive between the parties but can be challenged, for example for lack of jurisdiction or breach of natural justice. Many Muslim probashis therefore also follow the Bangladeshi notice procedure and register the divorce here, so that the Bangladeshi marriage record is formally closed.
