Hindu Marriage Registration and Separation in Bangladesh

Hindu marriage registration Bangladesh law provides for is optional under the Hindu Marriage Registration Act 2012, and an unregistered marriage with valid rites is still lawful. But a certificate is the easiest proof for visas, bank claims, inheritance and maintenance suits. This guide explains how registration works in Chattogram and what Hindu wives can claim in the Family Courts.
Key pointBecause Hindu personal law in Bangladesh does not allow divorce, a Hindu wife's main remedy is separate residence and maintenance under the 1946 Act, and a registration certificate removes the most common defence: the husband denying the marriage.
At a glance
Registration is optional
Section 3(1) of the Hindu Marriage Registration Act 2012 made registration discretionary, and failing to register a Hindu marriage is not an offence.
Validity is unaffected
A Hindu marriage solemnised with the required rites is valid whether or not it is registered; the Act defines Hindu marriage to include customary forms.
Child marriages excluded
Section 5 bars registration of a child marriage; the Child Marriage Restraint Act 2017 sets minimum ages of 21 for men and 18 for women.
No Hindu divorce
Hindu personal law as applied in Bangladesh does not provide for divorce, and the 2012 Act does not address dissolution of marriage at all.
Maintenance claims
Family Courts hear Hindu wives' claims for separate residence and maintenance under the 1946 Act, including past maintenance and children's accommodation.

Hindu marriage registration Bangladesh law provides for is optional. The Hindu Marriage Registration Act 2012 created a system of Hindu marriage registrars, but a Hindu marriage solemnised with valid rites is lawful whether or not it is registered. For couples in Chattogram, the practical question is not "must we register?" but "what happens later if we cannot prove the marriage?"
This guide explains what the 2012 Act does, how registration works, why it matters for visas, property and maintenance, and what a Hindu wife can and cannot claim in the Chattogram Family Courts, including separate residence and maintenance under the 1946 Act.
The short answer
Registration under the Hindu Marriage Registration Act 2012 is voluntary. Section 3(1) made registration optional, and non-registration is not an offence, as a Daily Star legal analysis explains. The Act was notified in the Gazette on 24 September 2012 and the Hindu Marriage Registration Rules followed in 2013, according to the Dhaka Tribune.
Registering is still wise. A registration certificate is the simplest proof that a marriage took place, and proof matters for visas, inheritance, bank nominee claims, and any later claim for maintenance or separate residence. Bangladeshi Hindu personal law does not provide for divorce, but a Hindu wife can sue in the Family Court for maintenance and a separate residence, and the courts regularly grant those claims.

What the Hindu Marriage Registration Act 2012 does
Before 2012 there was no statutory registration system for Hindu marriages in Bangladesh, and couples often had no certificate at all. The Dhaka Tribune reported that this made marriages hard to prove in court, at banks and for travel. The 2012 Act addressed the evidence problem without changing the substantive law of Hindu marriage.
- Optional registration. Section 3(1) made registration discretionary. An unregistered marriage solemnised with the required rites remains valid.
- All recognised forms. Section 2(c) defines a Hindu marriage to include all approved forms, including marriage by custom.
- No registration of child marriages. Section 5 prevents a child marriage from being registered. The Child Marriage Restraint Act 2017 sets the minimum ages at 21 for men and 18 for women.
- Registrars. The Ministry of Law, Justice and Parliamentary Affairs appoints Hindu marriage registrars, and by 2020 registrars had been appointed in almost all upazilas.
- Rules. The Hindu Marriage Registration Rules 2013 set out the procedure, forms and fees.
The Act does not deal with divorce. Registrars and lawyers have called for it to be amended to address divorce and to make registration compulsory, but as of October 2026 we are not aware of any such amendment.
Why Hindu marriage registration Bangladesh couples skip can cause problems later
A marriage certificate is the document every institution understands. Without it, a spouse may have to prove the marriage through witnesses, the priest, photographs and family evidence, often years later and sometimes against relatives who dispute it. The Dhaka Tribune listed the practical uses of registration, including visa applications and travel, transfers and gifts of assets, court evidence, and claims on bank deposits where a spouse is the nominee.
In Chattogram the issue comes up most often in four situations: a spouse applying for a visa to join a partner working abroad; a widow claiming her husband's bank deposits, savings certificates or pension; a wife suing for maintenance whose husband denies the marriage; and disputes over property when one spouse dies. Our guide to Hindu inheritance law explains why a widow's status matters for succession.
| Issue | Registered | Unregistered |
|---|---|---|
| Validity | Valid if solemnised with the required rites | Equally valid if solemnised with the required rites |
| Proof of marriage | Registration certificate | Witnesses, priest, photographs, family and community evidence |
| Visa and immigration | Certificate widely accepted, often with attestation | Embassies may ask for further evidence or refuse |
| Bank, pension and nominee claims | Straightforward proof of status | Institutions may ask for a court declaration or other proof |
| Maintenance suit | Marriage rarely in dispute | Husband may deny the marriage, adding an issue to the trial |
| Offence for not registering | Not applicable | Non-registration is not an offence |
How to register a Hindu marriage in Chattogram
The procedure is set by the 2013 Rules and administered by the Hindu marriage registrar for the relevant area. Requirements can vary in detail, so confirm the current documents and fee with the registrar before the appointment.
- Find the registrar. Identify the Hindu marriage registrar for the area where the marriage took place or where the couple lives in Chattogram city or the upazila.
- Prepare identity documents. National identity cards or birth registration certificates for both spouses, which also establish that both meet the minimum ages.
- Prepare evidence of the ceremony. Details of the date, place and rites, and the priest's particulars where available. Photographs help.
- Bring witnesses. Attend with witnesses who can confirm the marriage, with their identity documents.
- Complete the register and pay the fee. The registrar records the particulars in the register and charges the prescribed fee.
- Collect the certificate. Check every detail, including spellings that must match passports and NIDs, before you leave.
- Attest if needed abroad. For use overseas, arrange attestation through the relevant ministries and the destination country's embassy.
Couples who married years ago may still be able to register; ask the registrar what evidence of the original ceremony is needed. If you are planning a spouse visa, a property transfer or an inheritance claim, do it now rather than when the document is urgently needed, and make sure names match your passports exactly.
What registration does and does not do
The registrar records a marriage that has taken place; registration is not itself the ceremony. Expect questions about the date and place of the wedding, the rites performed and each spouse's identity and age. Because section 5 bars registering a child marriage, the registrar should refuse where either party was under the legal minimum age. Hindu marriage registration Bangladesh registrars carry out is a record of evidence: it does not cure a defect in the ceremony, and it does not validate a union that personal law would not recognise. Equally, a missing certificate never invalidates a marriage solemnised with the proper rites.
Separate residence and maintenance for Hindu wives
Hindu personal law as applied in Bangladesh does not allow divorce, so the main remedy for a wife in a broken marriage is a claim for separate residence and maintenance under the Hindu Married Women's Right to Separate Residence and Maintenance Act 1946. The Act lists grounds on which a wife may live apart and still claim maintenance, including cruelty, desertion and the husband taking another wife, together with a general ground of other justifiable cause, subject to provisos that can disentitle her.
Family Courts hear these claims
These suits are brought in the Family Court under the Family Courts Act 2023. Two recent High Court Division decisions show how they work:
- In Civil Revision No. 3859 of 2022 (judgment of 30 May 2024), a Family Court had decreed past maintenance and the cost of separate residence for a Hindu wife whose husband had taken a second wife, plus monthly sums for both. The High Court Division upheld the decree, removing only an automatic annual increase that it found too harsh on the facts.
- In Civil Revision No. 1900 of 2023 (judgment of 13 January 2025), the court explained that separate residence means a residence without the husband but owned, rented or managed by him, and that children are entitled to maintenance, including accommodation, until majority.
Our maintenance claim guide covers procedure, and the Family Court team handles these suits in Chattogram.
What a Hindu wife cannot claim
A Hindu wife cannot obtain a divorce decree under Hindu personal law in Bangladesh, and there is no Hindu equivalent of dower. Where there is violence, she can also seek orders under the Domestic Violence (Prevention and Protection) Act 2010; see our protection order guide. Couples who want a marriage that can be dissolved sometimes consider the Special Marriage Act 1872, which has its own conditions and consequences and needs advice before use.
Children, custody and proof of parentage
Registration also protects children. A child's birth registration should name both parents, and a marriage certificate supports that record if the father later disputes paternity, refuses support or a relative challenges the child's inheritance. Where the marriage breaks down, custody and guardianship of the children are decided by the Family Court on the child's welfare, applying the Guardians and Wards Act 1890 alongside personal law; our child custody guide explains the test.
Children's maintenance can be claimed in the same Family Court suit as the wife's claim. In a 2025 decision discussed above, the High Court Division confirmed that children are entitled to maintenance, including accommodation, until they reach majority. Hindu marriage registration Bangladesh families complete early makes each of these claims simpler, because the first contested question, whether there was a valid marriage at all, does not arise.
Reform: what has and has not changed
Hindu family law in Bangladesh has changed little in decades, and the 2012 Act was the most significant recent statute. Reform remains under discussion. In April 2025 the Women's Affairs Reform Commission recommended an ordinance giving women of all religions equal rights in marriage, divorce, inheritance and maintenance through a uniform family law, at least on an optional basis, according to Prothom Alo. The recommendation drew strong debate.
As of October 2026, we are not aware of any law enacted to introduce Hindu divorce, compulsory registration or a uniform family code. Families should plan on the basis of the law as it stands: register the marriage, keep proof of the ceremony, and use the existing remedies of separate residence, maintenance, custody and protection orders. If the law changes, a registered marriage will be easier to bring within any new scheme, which is one more reason Hindu marriage registration Bangladesh couples complete now is worth the small effort.
An illustrative scenario
This scenario is illustrative only; the parties are generic. A couple married by Hindu rites in a Chattogram upazila a decade ago and never registered. The husband now works in the Gulf and has stopped supporting his wife and son. When she files for maintenance and separate residence in the Family Court, he denies the marriage.
She must now prove the marriage through the priest, wedding photographs, the child's birth registration naming the father, and witnesses. The claim can still succeed, but the trial is longer and costlier. Had the couple completed Hindu marriage registration Bangladesh law offers, the certificate would have settled the point on the first day.
Risks and common mistakes
Assuming registration is pointless because it is optional
Optional does not mean unimportant. The certificate is the cheapest insurance a couple can buy against later disputes about status, from visas to bank claims. Hindu marriage registration Bangladesh couples complete at the time of the wedding avoids the cost of proving the marriage through witnesses years later, when memories have faded and relatives may have taken sides.
Registering an underage marriage
Section 5 of the 2012 Act prevents a child marriage from being registered, and the Child Marriage Restraint Act 2017 makes child marriage an offence. A registrar should refuse, and anyone who supplies false age documents risks prosecution. Check ages against NIDs or birth registration before the ceremony, not afterwards.
Expecting a divorce under Hindu law
Many couples, especially those familiar with Indian law, assume a Hindu marriage can be dissolved in Bangladesh. It cannot under Hindu personal law as applied here. A wife's remedies are separate residence, maintenance, protection orders and custody. Plan around those remedies, and take advice before any step, such as conversion or a foreign divorce, that could have unexpected consequences in Bangladesh.
Mismatched names and details
A certificate with spelling that differs from the passport or NID can cause as much trouble abroad as having no certificate. Embassies and banks compare documents line by line. Check every entry before signing the register and ask for corrections immediately, because changing a record later is slower.
Couples living abroad
Many Chattogram families have a spouse in the Gulf, the UK or South-East Asia. Spouse visa applications usually require proof of marriage, and a registration certificate, properly attested, is far easier to use than affidavits and photographs. A wife whose husband works abroad can still sue for maintenance in Chattogram, and the Family Court's decree can be executed against assets in Bangladesh. Where a husband abroad ignores the suit, the court can proceed on proof of service, so keep his foreign address, phone numbers and any messages. Frequently asked questions
01Is Hindu marriage registration compulsory in Bangladesh?
No. Section 3(1) of the Hindu Marriage Registration Act 2012 made registration optional, and non-registration is not an offence. A Hindu marriage solemnised with the required rites is valid without registration. Registration is nevertheless strongly advisable because the certificate is the simplest proof of the marriage for visas, bank and pension claims, inheritance and any maintenance suit. Advocates and registrars have called for registration to become compulsory, but as of October 2026 we are not aware of an amendment.
02Where do we register a Hindu marriage in Chattogram?
With the Hindu marriage registrar appointed by the Ministry of Law, Justice and Parliamentary Affairs for the relevant area. Registrars have been appointed in almost all upazilas. Bring both spouses' NIDs or birth registration certificates, details of the ceremony and witnesses, and confirm the current documents and fee with the registrar in advance. Check the certificate carefully for spellings that must match passports.
03Can a Hindu marriage be registered years after the wedding?
Couples who married earlier may be able to register later, provided the marriage was solemnised with valid rites and both parties met the legal age requirements. The need often arises when a spouse needs a visa or a widow needs to prove her status, so ask the registrar in advance what is required. Bring as much evidence of the original ceremony as possible, such as the priest's details, photographs and witnesses, because the registrar records particulars of the marriage that took place.
04Can a Hindu wife get a divorce in Bangladesh?
Not under Hindu personal law as applied in Bangladesh, which does not provide for divorce, and the 2012 Act does not address it. A Hindu wife can instead claim separate residence and maintenance under the Hindu Married Women's Right to Separate Residence and Maintenance Act 1946 in the Family Court, seek custody and maintenance for children, and obtain protection orders under the Domestic Violence (Prevention and Protection) Act 2010 where there is violence.
05What can a Hindu wife claim for maintenance and residence?
Under the 1946 Act, a wife who lives apart on a recognised ground, such as cruelty, desertion or the husband taking another wife, may claim maintenance and the cost of a separate residence. In a 2024 decision the High Court Division upheld a Family Court decree for past maintenance and monthly sums. In 2025 it explained that separate residence means one owned, rented or managed by the husband, and that children are entitled to maintenance including accommodation until majority.
06Does an unregistered marriage affect a Hindu widow's inheritance?
Registration does not change inheritance shares, which follow Hindu personal law. But a widow must prove she was validly married to claim as widow, and relatives sometimes dispute that. A registration certificate makes proof simple; without it, she must rely on witnesses, the priest, photographs and documents such as children's birth registrations. Banks and land offices may also ask for stronger proof before releasing deposits or recording mutation.
