Anticipatory Bail Lawyer in Chittagong (Chattogram)

An anticipatory bail lawyer in Chittagong helps a person named in a criminal case avoid arrest before the court has looked at the allegation. The application goes to the High Court Division under section 498 of the Code of Criminal Procedure, protection is usually time-limited, and the case then returns to the Chattogram courts for surrender and regular bail.
Key pointAnticipatory bail is a bridge, not a destination: the High Court Division usually protects you for a limited period and then sends you to surrender before the Chattogram court, so the regular bail petition must be ready before the first order is even made.
At a glance
Rooted in section 498
Anticipatory bail rests on the High Court Division's power under section 498 of the Code of Criminal Procedure, developed through case law rather than a dedicated section.
Usually time-limited
Protection is commonly granted for a set period or until the police report, with a direction to surrender before the trial court in Chattogram.
Heard in Dhaka
The High Court Division sits in the Supreme Court in Dhaka, while the case record, investigation and later surrender remain in Chattogram.
Special laws are stricter
Women and children repression, narcotics, anti-corruption and cyber cases carry their own bail rules, raising the bar for pre-arrest protection.
Presence is expected
The applicant is normally expected to appear in person, so NRB clients should prepare the file abroad and move the court soon after arriving.

What an anticipatory bail lawyer in Chittagong does
An anticipatory bail lawyer in Chittagong protects a person from arrest in a criminal case that has been filed, or is clearly about to be filed, before the police reach them. Instead of waiting to be picked up and produced before a magistrate, the person applies to a higher court for an order that, if arrested, they must be released on bail.
The remedy is temporary by design. In Bangladesh it usually comes from the High Court Division in Dhaka for a fixed period, or until the police report is filed, with a direction to surrender before the trial court in Chattogram and seek regular bail there. Used well, it turns a frightening arrest into a planned court appearance.
In Chattogram, anticipatory bail questions come up in many settings: business partners facing cheating or breach-of-trust complaints, families caught in dowry or women and children repression cases, employers named after a workplace incident, landowners in boundary fights that turn violent, and people abroad who learn that a case has been lodged against them at home.

The legal basis for anticipatory bail in Bangladesh
Bangladesh has no stand-alone anticipatory bail section of the kind found in some neighbouring systems. The power rests on section 498 of the Code of Criminal Procedure 1898, which allows the High Court Division and the Court of Session to grant bail in any case. Through decades of case law, the higher courts have read that power as extending to a person who has not yet been arrested.
Because the remedy is judge-made, the conditions come from the case law rather than from a single statutory text. The Appellate Division has laid down guidelines that the High Court Division must follow, and has said that anticipatory bail is an extraordinary remedy that should not be granted indefinitely. An anticipatory bail lawyer in Chittagong therefore builds every application around those settled principles rather than around general sympathy.
What the court looks for
In broad terms, the High Court Division asks whether the applicant has a real and reasonable fear of arrest, whether there are signs that the case is motivated by harassment or a collateral dispute, whether the applicant is likely to abscond or tamper with evidence, and whether the applicant can show special circumstances that justify protection before arrest rather than ordinary bail after it. The nature and gravity of the offence weigh heavily.
Special laws and stricter regimes
Several special statutes contain their own bail provisions, which colour how the High Court Division approaches pre-arrest protection. Cases under the Women and Children Repression Prevention Act 2000, the Narcotics Control Act 2018, anti-corruption law and cyber security law are the most common examples in Chattogram. Protection is still possible in some of these cases, but the threshold is noticeably higher and the file must be stronger.
2025 and 2026 procedural reforms
The Code of Criminal Procedure (Second Amendment) Ordinance 2025 introduced arrest safeguards, limits on remand and an early-release route for people wrongly named in an investigation, and Parliament followed with the Code of Criminal Procedure (Amendment) Act 2026. These reforms do not replace anticipatory bail, but they change the risk assessment: a person who is arrested now has stronger procedural protection at the first production, which can affect whether pre-arrest bail is the right move at all.
When anticipatory bail is the right step
Not every threatened case needs anticipatory bail. A good anticipatory bail lawyer in Chittagong starts by asking whether it is necessary, because an unsuccessful application leaves a record that later courts will see, and a successful one still ends with a surrender.
| Situation | Usual approach | Why |
|---|---|---|
| Bailable offence only | Appear or surrender; bail is a right | Anticipatory bail adds little where release is an entitlement |
| Court complaint (CR case) at the summons stage | Appear on summons with a lawyer and seek bail | The court has chosen summons, not a warrant, so arrest risk is lower |
| Police case (FIR) for a non-bailable offence, applicant not yet arrested | Consider anticipatory bail from the High Court Division | Avoids arrest and remand before the court has examined the case |
| Warrant already issued by a Chattogram court | Anticipatory bail or a planned surrender with a bail petition | Depends on the offence, the evidence and the likely approach of the trial court |
| Special-law case with strict bail rules | Careful assessment; anticipatory bail is possible but harder | Higher threshold; a weak application can damage later bail prospects |
| Applicant abroad | Plan the return, then apply on arrival or surrender with counsel | The court normally expects the applicant to be personally present |
The comparison with ordinary bail is explained on our bail lawyer in Chittagong page, and the wider defence picture on the criminal defence page.
Anticipatory bail does not end a case. It buys time and dignity: the chance to answer the allegation in court, prepared, rather than from a police lock-up.
How anticipatory bail works for Chattogram cases
A Chattogram case has two homes during the anticipatory bail process. The FIR or complaint sits with a police station in the Chattogram Metropolitan area or the district, and the record stays with the Chattogram magistrate court, sessions court or special tribunal. The anticipatory bail application, however, is filed and heard in the Supreme Court building in Dhaka, because the High Court Division sits there.
In practice, the High Court Division often grants interim anticipatory bail for a limited number of weeks, or until the police report is submitted, and directs the applicant to surrender before the court in Chattogram within or at the end of that period. A recent High Court Division order in an anticipatory bail matter shows the pattern: an initial period, an extension, and finally protection until the police report, conditional on a bond to the satisfaction of the magistrate.
Once the applicant surrenders in Chattogram, the trial court decides regular bail. That is why the anticipatory bail lawyer in Chittagong must prepare both stages together: the High Court application and the bail petition that will be argued before the Chattogram district judiciary when the protection period ends.
Keep a certified copy of the High Court order and the bail bond with you at all times during the protection period. Police in Chattogram may not know about an order made in Dhaka, and the quickest way to stop an arrest is to show the order and contact your lawyer at once.
The process, step by step
- Obtain the case papers. Get the FIR or complaint petition, the case number, the police station and any order already made by the Chattogram court. If no case has been filed yet, collect the threats, notices or messages that show one is coming.
- Assess the offence and the forum. Identify whether the offences are bailable, which court will try them, and whether a special law with stricter bail rules applies.
- Decide the strategy. Choose between anticipatory bail, a planned surrender with a bail petition, or appearance on summons. Consider related civil or family proceedings that explain the case.
- Prepare the application. Draft the criminal miscellaneous application under section 498 with an affidavit, annexing the FIR, the background documents and any medical or personal papers that support special circumstances.
- Move the High Court Division. File and mention the matter before the bench with criminal miscellaneous jurisdiction. The applicant is normally expected to be present in person.
- Comply with the order. Furnish the bond as directed, keep certified copies, and diarise the expiry date and surrender date exactly.
- Surrender in Chattogram and seek regular bail. Appear before the trial court within the time allowed with a prepared bail petition, citing the High Court order and good conduct during the protection period.
- Protect bail and defend the case. Attend every date, watch for cancellation applications, and pursue discharge, quashing or trial defence as the case develops.
The anticipatory bail process article explains each stage in more detail, and the first 24 hours after arrest guide covers what happens if police act before the application is heard.
Documents and evidence to assemble
A strong application is built on documents, not adjectives. Before the anticipatory bail lawyer in Chittagong drafts anything, gather the following:
- A copy of the FIR or complaint petition, the case number and the police station, and any order sheet from the Chattogram court.
- National ID card, passport and proof of address, which show roots in the community and reduce absconding concerns.
- Documents showing the background dispute: deeds, contracts, bank records, partnership papers, earlier civil suits, family court filings or settlement drafts.
- Messages, notices, or recorded threats that show the case was filed to pressure or retaliate.
- Medical records where age, illness or disability supports special circumstances.
- Employment or business papers showing that the applicant is settled and has obligations that make flight unlikely.
- For applicants abroad, travel documents, return tickets and proof of residence or work overseas.
Where the allegation turns on electronic messages or posts, read our page on cyber crime defence, because device evidence needs careful handling from the outset.
Risks and common mistakes
Applying with a thin record
The most common mistake is rushing to the High Court Division with only the FIR and a short affidavit. If the bench refuses, the refusal follows the applicant to the trial court and to any later application. It is usually better to spend a few days assembling the background documents that show why the case is doubtful or why protection is justified. An anticipatory bail lawyer in Chittagong should be candid about whether the file is ready, even when the client wants to move immediately.
Missing the surrender date
Anticipatory bail orders are time-limited. If the applicant fails to surrender before the Chattogram court within the time allowed, the protection lapses and a warrant can be executed. Worse, the trial court may treat the failure as evidence that the applicant cannot be trusted on bail. Diarise the expiry date, plan travel to Chattogram in advance, and have the regular bail petition ready well before the deadline. Extensions are possible in some cases, but they must be sought before the order expires, not after.
Hiding earlier applications or orders
Courts expect full disclosure of earlier bail applications, refusals and related cases. Suppressing a previous refusal or an earlier order can lead to cancellation of bail and adverse comment from the bench. Every application should list what has already happened in the case, including any order by a Chattogram magistrate or sessions judge and any related case filed by or against the applicant. Candour is not only an ethical duty; it also protects the order once granted.
Treating anticipatory bail as the end of the case
Anticipatory bail protects liberty for a period. It does not dismiss the case, stop the investigation or prevent a charge sheet. Clients sometimes relax once the order is made and ignore the investigation. That is a mistake: the period of protection is the best time to give documents to the investigating officer, seek an early release where the new procedure allows it, or prepare a quashing or discharge application. Our false case defence page explains those routes.
Contact with the complainant or witnesses
Bail orders usually come with conditions, express or implied, that the applicant must not threaten or influence witnesses. Even well-meant attempts to settle a dispute directly with the complainant can be presented as intimidation and used to seek cancellation. Settlement talks, where appropriate and lawful, should go through lawyers and be documented. In family and dowry-related cases especially, a single heated phone call can undo weeks of careful work.
Anticipatory bail in women and children, narcotics and other special cases
Many Chattogram cases fall under special statutes, and each changes the analysis. In cases under the Women and Children Repression Prevention Act 2000, the statute contains its own restrictions on bail, which the courts apply alongside the general law. The High Court Division can still grant protection, but it looks closely at the allegations, the medical evidence and any history of family or matrimonial disputes. See our page on Nari O Shishu cases.
In narcotics cases, anticipatory bail is rare where the allegation involves recovery of a large quantity from the applicant, because the Act treats the gravest quantities with the most severe punishments. It is more realistic where the applicant is named on suspicion, or where the recovery was from someone else. Our drug case defence page explains how those cases run in Chattogram.
In anti-corruption, money laundering and cyber cases, the investigating agency and the special judge play a central role, and the High Court Division considers the documentary record closely. In cheque dishonour cases, by contrast, the offence is usually approached through summons and settlement, and anticipatory bail is rarely the first tool.
Anticipatory bail for Bangladeshis abroad and foreign nationals
Many clients of an anticipatory bail lawyer in Chittagong are not in Chattogram at all. Non-resident Bangladeshis in the UK, the Gulf, Singapore and elsewhere often learn about a case from relatives, sometimes after a property or inheritance dispute has turned criminal. They want to come home, visit family or deal with property without being arrested at the airport.
The High Court Division generally expects the applicant to be personally present when anticipatory bail is sought, so the usual plan is to prepare the full application while the client is still abroad, arrange travel, and move the court promptly after arrival. While the client is overseas, we can obtain certified copies of the case record, check whether a warrant has issued, and advise on the NRB legal issues that often sit behind the criminal case.
Foreign nationals working in Chattogram's export zones, port businesses and projects face the same issues, sometimes with immigration consequences. TRW & Co's offices in Dhaka, Singapore, Dubai and London help coordinate documents, consular contact and timing, while our Bangladesh advocates handle the court work.

We obtain the FIR or complaint, check the order sheet and identify the offences, the forum and any special-law bail rules. You get a clear view of whether anticipatory bail, surrender or appearance on summons is the better course.
High Court Division application
We draft and file the section 498 application with a full affidavit and annexures, and present it before the appropriate bench in Dhaka. Our Dhaka office supports filing, mentioning and certified copies.
Surrender and regular bail in Chattogram
We prepare the regular bail petition in advance and appear when you surrender before the Chattogram court, so protection carries over without a gap where possible.
Investigation engagement
During the protection period we place documents before the investigating officer, pursue early release where the amended procedure allows it, and prepare for discharge or quashing if the case is baseless.
Parallel civil and family work
Many criminal cases grow out of land, business or family disputes. We coordinate with our civil litigation and family teams so that each forum supports the other.
Clients overseas
For NRB and foreign clients, we prepare the file before you travel, check for warrants, and plan the timing of your return and appearance so you are not exposed on arrival.

Frequently asked questions
01What is anticipatory bail and who grants it in Bangladesh?
Anticipatory bail is an order protecting a person from arrest in a case that has been filed or is clearly threatened, so that if arrested they must be released on bail. In Bangladesh it rests on section 498 of the Code of Criminal Procedure, which empowers the High Court Division and the Court of Session to grant bail in any case. In practice, applications are made to the High Court Division in Dhaka, which grants protection for a limited period and directs the applicant to surrender before the trial court in Chattogram.
02How long does anticipatory bail last?
Orders are usually time-limited. The High Court Division commonly grants protection for a number of weeks, or until the police report is submitted, and may extend it on application where the applicant has not misused the privilege. The Appellate Division has said that anticipatory bail should not be granted indefinitely. At the end of the period, the applicant must surrender before the Chattogram court and seek regular bail there, which is why the surrender petition should be prepared from the start.
03Can I get anticipatory bail before an FIR is filed?
Anticipatory bail is normally sought in an identified case, so the court can see the allegation, the offences and the forum. Where no case has yet been filed, the High Court Division is generally cautious. If you fear a case, the better first step is usually to collect evidence of threats and the background dispute, monitor the police station and court, and be ready to move quickly once the case number exists. An anticipatory bail lawyer in Chittagong can advise on that monitoring.
04Do I have to attend the High Court personally?
The applicant is generally expected to be present in person when anticipatory bail is sought, because the court is deciding whether that individual can be trusted at liberty. For clients outside Bangladesh, this means planning the return carefully: preparing the full application in advance, checking whether a warrant has issued, and arranging to move the High Court Division promptly after arrival. We coordinate timing so that exposure to arrest is minimised.
05Is anticipatory bail possible in a Nari O Shishu or narcotics case?
It can be, but the threshold is higher. The Women and Children Repression Prevention Act 2000 contains its own bail restrictions, and the Narcotics Control Act 2018 treats the gravest quantities with the most severe penalties. The High Court Division looks closely at the allegations, the evidence and any background dispute. Where a person is named on suspicion or the case appears to grow out of a family or property conflict, protection may be realistic. Each case must be assessed on its own papers.
06What happens if I miss the surrender date?
If you do not surrender before the Chattogram court within the time the High Court Division allowed, the protection lapses and a warrant can be executed. The trial court may also treat the failure as a reason to refuse regular bail. If you cannot attend on time because of illness or another genuine reason, your lawyer must seek an extension before the order expires and support it with evidence. Never let the date pass without action.
07Does anticipatory bail stop the investigation or the case?
No. It protects your liberty for a period but does not dismiss the case or halt the investigation. Police can still investigate and file a charge sheet. The protection period is, however, the best time to give documents to the investigating officer, seek early release where the amended procedure allows it, and prepare discharge or quashing applications if the case has no proper basis.
